These Terms and Conditions apply to the purchase of tickets and entry to the Perricoota Pop & Pour Festival 2026 (the Event), organised by EM Events Pty Ltd (the Organiser). By purchasing a ticket, holding a ticket, or attending the Event, you agree to be bound by these Terms and Conditions.
1. Ticketing and Entry
1.1 All Sales are Final: All ticket sales are final. Tickets are non-refundable and non-exchangeable, except as required by the Australian Consumer Law or the Live Performance Australia Ticketing Code of Practice.
1.2 Starting Venues: Tickets are sold with a designated starting venue. You must commence your festival experience at this designated venue. Entry or transport access will be refused if you attempt to start at a venue other than the one specified on your ticket.
1.3 Age Restriction: The Event is strictly an 18+ event. Valid government-issued photo identification (Driver's Licence, Passport, or Proof of Age card) must be presented upon entry. Minors, including infants and babies, will not be permitted entry under any circumstances.
1.4 Wristbands: Upon scanning a valid ticket at your designated starting venue, you will be issued an official Event wristband. This wristband must be worn at all times. Lost, damaged, or tampered wristbands will not be replaced, and you will be denied entry to venues and transport services.
1.5 Resale: Tickets may not be resold at a premium, used for advertising, promotion, or other commercial purposes without the prior written consent of the Organiser. Tickets purchased from unauthorised third-party sellers (e.g., Viagogo, Facebook marketplace) may be cancelled without refund and entry refused.
2. Refunds and Cancellations
2.1 Event Changes: The Organiser reserves the right to add, withdraw, reschedule, or substitute artists, venues, or transport services, and/or vary advertised programs, prices, and venue capacities. No refunds will be provided for such changes, including the cancellation of a specific artist or a change in the entertainment lineup.
2.2 Event Cancellation: If the entire Event is cancelled, rescheduled, or significantly relocated, you may be entitled to a refund of the ticket price in accordance with the Australian Consumer Law. Booking fees and transaction fees are non-refundable.
2.3 Weather: The Event will proceed rain, hail, or shine. No refunds will be provided due to adverse weather conditions unless the Organiser deems the conditions unsafe and cancels the Event.
2.4 Change of Mind: Refunds will not be provided for a change of mind, change of personal circumstances, or if you are unable to attend the Event.
3. Conditions of Entry and Conduct
3.1 Right to Refuse Entry: The Organiser, venue management, and security personnel reserve the right to refuse entry or evict any person who behaves in a disorderly, disruptive, or inappropriate manner, or who breaches these Terms and Conditions. No refunds will be provided in such instances.
3.2 Responsible Service of Alcohol (RSA): The Event and all participating venues strictly adhere to RSA principles. Intoxicated persons will be refused service, refused entry, or evicted from the Event.
3.3 Prohibited Items: The following items are strictly prohibited and will be confiscated:
Outside alcohol or illicit substances
Weapons of any kind
Glass containers
Flares, fireworks, or sparklers
Megaphones, sirens, or noise-making devices
Professional recording equipment (without prior media accreditation)
Animals (excluding registered service animals)
3.4 Bag Checks: Security personnel may conduct bag checks upon entry to venues or transport services. Refusal to consent to a bag check may result in denial of entry.
3.5 Transport: Access to the official Event transport network (buses and boats) requires a valid, intact Event wristband. The Organiser reserves the right to refuse transport to any person displaying intoxicated or anti-social behaviour.
4. Photography and Media Consent
4.1 Consent to be Filmed/Photographed: By attending the Event, you consent to being filmed, photographed, and recorded. You grant the Organiser, its partners, and approved media the right to use these images and recordings for promotional, marketing, and broadcast purposes in perpetuity, without compensation.
4.2 Opt-Out: If you do not wish to be filmed or photographed, you must notify the Ticket Exchange Desk upon arrival. You will be issued a specific identifier (e.g., a secondary wristband) to signal your non-consent to official photographers.
5. Liability and Risk
5.1 Assumption of Risk: Entry to the Event is at your own risk. To the maximum extent permitted by law, the Organiser, participating venues, artists, and contractors accept no responsibility for any injury, loss, damage, or theft of personal property occurring at the Event or on Event transport.
5.2 Limitation of Liability: The Organiser's liability for any breach of a term or guarantee implied by law is limited, at the Organiser's discretion, to the replacement of the ticket or the refund of the ticket price.
6. General
6.1 Amendments: The Organiser reserves the right to update or amend these Terms and Conditions at any time. The most current version will be available on the official Event website.
6.2 Severability: If any part of these Terms and Conditions is held to be invalid or unenforceable, that part will be severed, and the remaining terms will continue in full force and effect.
